W1 Performer Terms & Conditions

  • “Agent” means W1 Music.

"Performer" refers to the individual booked by The Agent to perform for The Client.

“Client” means the person or company that wishes to hire The Performer via The Agent to perform at their event.

“Event” means the event that The Performer is booked to perform at via The Client.

  • As a representative of The Agent, The Performer agrees to conduct themselves professionally at all times, including pre-event rehearsals, the event itself, and any post-event responsibilities. The Performer shall:

    • Respect all event staff, performers, guests, and venue property.

    • Refrain from using illegal drugs or consuming excessive alcohol before, during, or after a performance.

    • Maintain a positive and cooperative attitude.

    • Avoid behavior that could be deemed offensive, discriminatory, or unsafe.

    • Be punctual.

    • Not solicit business directly from any Agency client, venue, or guest at an Agency booking.

Breach of conduct may result in immediate removal from the event without payment, as well as financial liability for any damage caused.

  • Payment for services rendered will be processed in the following manner:

    • The Agent will pay The Performer a pre-agreed fee for each confirmed performance.

    • The Agent will make payment within 30 days of receipt of the invoice unless otherwise agreed. In the unlikely event that payment is to take longer than 30 days, this will be agreed with the Performer before confirmation of the Event.

    • Payment will be issued via bank transfer to the account details provided on the Performer's invoice.

    • The Performer is responsible for providing invoices, accurate payment information, and for any taxes associated with their earnings.

  • In the event the cancellation is initiated by The Performer:

    • Must provide as much notice as possible and will forfeit any payment for that performance.

    • Must suggest a suitable ‘Dep’ Performer of the calibre commensurate to W1 Music and stylistically appropriate for the Event.

In the event the cancellation is initiated by The Client:

    • The Agent will attempt to reschedule the event.

    • If rescheduling isn’t possible, the Agent will pursue any monies owed on behalf of the Performer.

  • The Performer is expected to dress appropriately in accordance with the event theme, style, or branding.

    • Attire should be professional, clean, and performance-ready.

    • Any specific dress code requirements will be communicated by The Agent in writing.

  • All communication must be conducted directly with The Agent, and not with The Client, venue or any other third party.

The Performer and The Agent agree to:

    • All official correspondence regarding Events will be communicated exclusively via email.

    • Whatsapp and phone calls may be used to facilitate easy communication but must not be considered official communication.

    • Maintain clear, professional, and timely communication.

    • Confirm any event changes in writing via email.

  • If a rehearsal is required:

    • The Performer is expected to be well rehearsed and prepared for the event.

    • Punctuality and preparedness are expected.

    • It will be treated with the same professionalism as the performance itself.

    • It may be unpaid unless otherwise specified in the booking details.

    • The Agent will present a booking opportunity to The Performer with all relevant details, including but not limited to the date, time, location, duration, and fee.

    • The Performer must confirm their availability and acceptance of the booking promptly after receiving the offer.

    • A booking is only considered confirmed once The Agent has written to The Performer to confirm the event via email.

  • Any equipment provided by The Agency is not available for use by other performers or persons except with specific written permission of The Agency.

  • The Performer hereby grants The Agency a non-exclusive, worldwide, royalty-free license to use their name, likeness, and any photographs, video recordings, or audio recordings taken during performances for promotional purposes. This includes, but is not limited to, use on The Agency's website, social media, and marketing materials.

  • In the event of a dispute or complaint, The Performer must put the issue in writing to The Agent within 28 days of the event.

  • The relationship between The Agent and The Performer may be terminated by The Agent at any time, with immediate effect, if The Performer fails to adhere to any of the terms and conditions set out previously.

    • In the event of such termination, The Performer shall not be entitled to any compensation for future bookings and may be liable for any damages or losses incurred by The Agent as a result of their breach of the terms and conditions.

The relationship between The Agent and The Performer may be terminated by The Performer at any time, with immediate effect, but they will be obliged to:

    • Fulfil any confirmed bookings or find suitable ‘Dep’ Performers with written consent from The Agent.

    • Request written consent from The Agent for the use of any content or material paid for and owned by The Agent.

    • May be liable for any losses incurred by the Agent
